Common Construction-Site Injuries in Prairieville

Construction work places employees around elevated surfaces, moving equipment, electrical systems, and active excavation areas. The circumstances of an accident may identify the employer responsible for coverage and show whether someone outside the employment relationship contributed to the injury.

Construction accidents frequently involve:

  • Falls from roofs, ladders, scaffolding, and other elevated work areas
  • Trench collapses and excavation incidents
  • Heavy-equipment and heavy-machinery accidents
  • Electrocutions and contact with energized equipment
  • Struck-by-object injuries involving tools, materials, or debris
  • Forklift and workplace-vehicle collisions

Heavy machinery claims require close attention to the work environment and the sequence of events leading to the injury. A single construction site may involve a general contractor, several subcontractors, and equipment providers. Identifying each party’s role helps us evaluate available benefits and possible responsibility outside the employment relationship.

Coverage on Multi-Employer Construction Sites

Louisiana’s workers’ compensation system is generally no-fault, so an injured employee doesn’t have to prove that an employer acted negligently before seeking covered benefits. Disputes can still arise over employment status, whether the accident occurred in the course of work, and which entity is responsible for coverage.

Statutory employer status: A principal may be treated as an employer even if it didn’t directly hire the injured person. A general contractor or another principal may receive this designation when it hires a contractor to perform work that’s part of its trade, business, or occupation. If the rule applies, the statutory employer may be responsible for benefits as though it directly employed the contractor’s worker.

Independent contractor classification: Being labeled an independent contractor doesn’t automatically resolve eligibility. Louisiana’s manual labor exception may extend coverage to some independent contractors when manual labor forms a substantial part of their work for the principal’s trade or business. We examine the actual working arrangement rather than relying solely on the title used in an agreement or payroll record.

Benefits After a Louisiana Construction Accident

Available benefits may address necessary medical treatment, lost wages, disability, or a work-related death. Eligibility and payment amounts depend on medical evidence, wage records, work capacity, and other facts. The system doesn’t provide damages for pain and suffering.

Potential benefit categories include:

  • Medical Benefits: Coverage for treatment related to the compensable construction injury.
  • Temporary Total Disability Benefits: Payments equal to 66 2/3% of the employee’s average weekly wage, subject to the maximum and minimum amounts set by the Office of Workers’ Compensation Administration.
  • Supplemental Earnings Benefits: Payments that may apply when a worker returns to employment but earns less than 90% of the pre-injury wage.
  • Death Benefits: Benefits that may be available to qualifying dependents after a covered fatal accident, along with up to $8,500 for reasonable burial expenses.
  • Catastrophic Injury Payment: A one-time payment of $50,000 when an injury meets Louisiana’s statutory definition of catastrophic.

Louisiana Reporting Deadlines & Claim Procedures

An injured worker generally must notify the employer within 30 days of the injury or death to maintain a compensation proceeding. Weekly indemnity claims generally must be filed within one year of the accident. If indemnity benefits were paid and later stopped, the applicable period is generally one year from the last payment. Other deadlines may apply based on the benefit and dispute involved.

When an insurer contests benefits, a worker can initiate a case by filing Form LWC-WC 1008, formally called a Disputed Claim for Compensation. The filing goes to the Office of Workers’ Compensation Administration, which has exclusive original jurisdiction over disputed claims under Louisiana law.

We handle communications with employers and insurance companies from the outset. If the dispute continues, we represent clients at administrative hearings before a workers’ compensation judge. The injured worker has one direct point of contact throughout the process.

Options After a Denial or an Outside Party’s Negligence

A denial isn’t necessarily the end of a claim. The worker can bring the dispute before the Louisiana Office of Workers’ Compensation, where a judge considers the evidence and applicable law. Contested issues often include coverage, medical causation, disability status, and entitlement to wage benefits.

A separate third-party liability claim may exist when someone outside the employment relationship caused the accident. That party could be another subcontractor whose conduct created the hazard or an equipment manufacturer responsible for a defective machine. A civil claim can proceed alongside a benefits claim, although the two may affect one another.

The 23rd Judicial District Court has original jurisdiction over civil matters in Ascension Parish, including a related third-party tort claim. We evaluate the job-site relationships and accident circumstances to determine whether employer-provided benefits are the only potential source of recovery or whether another party’s liability should also be considered.
