Information on Death Cases

I am sorry for your loss.

If the death was recent, you are dealing with the loss of your loved one, immediate financial pressure and a host of other problems that just seem to linger unresolved.  I understand what you are going through. If your loved one passed away some time ago and you are receiving weekly workers’ compensation death benefits, then you may be ready to settle the case for a lump sum to pay off bills.  In either case, I would be happy to try to help.

The survivors of someone who died during the course and scope of employment may be entitled to benefits pursuant to the Workers’ Compensation Act of Louisiana.

In order to be eligible for work comp death benefits, a person must be the surviving spouse or a dependent child of the deceased employee.  If the deceased employee had no surviving spouse or dependent children, the surviving parents may be eligible for a lump sum payment

The death benefit provides payment for all or part of funeral expenses and provides weekly payments representing a percentage of the deceased employee’s wages.  The percentage is based upon marital status and number of dependants of the deceased at the time of his or her death or, if the deceased was unmarried and without dependents, then the surviving parents are eligible for a lump sum payment of $75,000 each.

Do not accept the adjuster’s word on what your case may be worth before you speak with an attorney.  The insurance company is trying to pay as little as it can get away with to settle your claim.

I would be happy to speak with you personally, on the telephone, or by email about your case.  I will explain what the insurance company owes you and why at no cost or obligation to you.  I am one phone call away.  Toll Free 1-866-712-2667 or in Baton Rouge 225-387-0293 or by email.  My firm represents injured workers all over the State of Louisiana.  Fill out this short case consultation form  and I will contact you at your convenience..
